These Terms of Service govern your use of jadewell.me and the purchase of jadewell products. Jadewell is operated by jadewell, Inc., a Delaware corporation. By using the site, taking the Pattern Quiz, or purchasing a subscription, you agree to these terms.
1. What jadewell offers
Jadewell offers two products.
The Signature Formula is a monthly subscription to a classical Chinese Herbal Medicine formula in tea pill form, matched to you through the Pattern Quiz and reviewed by a board certified, licensed Traditional Chinese Medicine herbalist before it ships. The Signature Formula is available nationwide.
The Custom Formula is a clinical service in which a board certified, licensed Traditional Chinese Medicine herbalist works with you directly and compounds a Chinese Herbal Medicine formula in granule form specific to you, adjusted over time.
Where a section of these terms applies to only one product, it is labeled accordingly. Unlabeled sections apply to both.
2. Supplement status and the Pattern Quiz
Jadewell products, both Signature Formula and Custom Formula, are dietary supplements. These statements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease.
The Pattern Quiz identifies traditional Chinese Herbal Medicine patterns for the purpose of matching you to a formula. It is not a medical diagnostic tool, and its results are not a diagnosis of any medical condition. Nothing on the site, in the quiz, in your results, or in communications from jadewell constitutes medical advice. Always consult your physician before starting any supplement, and never delay or discontinue medical care because of anything you learn from jadewell.
3. Practitioner review (Signature Formula)
Every Signature Formula order is reviewed by a board certified, licensed Traditional Chinese Medicine herbalist before it ships. This review is a safety and suitability screen of your quiz responses. It does not create a practitioner-patient relationship, does not constitute a medical consultation, examination, diagnosis, or treatment, and does not replace care from your own healthcare providers.
The reviewing herbalist may contact you with questions before approving your Signature Formula order, may recommend a different formula than your quiz match, or may decline to approve your order. If your order is declined, you will receive a full refund of any amount paid and your subscription will be cancelled.
4. Practitioner care (Custom Formula)
The Custom Formula includes care from a board certified, licensed Traditional Chinese Medicine herbalist licensed in your state, including an intake consultation, a compounded Chinese Herbal Medicine formula, ongoing formula adjustment, and messaging with your herbalist between visits. The Custom Formula does create a practitioner-patient relationship with your herbalist within the scope of Traditional Chinese Medicine herbal practice. It does not replace your physician, and your herbalist does not provide Western medical diagnosis or treatment. Consultations may be conducted by telehealth, and by purchasing the Custom Formula you consent to receiving care by telehealth where permitted by your state. Additional consent and practice documents will be provided at intake.
5. Eligibility
You must be 18 or older and located in the United States to purchase either product. Jadewell products are not for use during pregnancy or while nursing.
The Signature Formula ships to all US states. The Custom Formula is available only to residents of states where jadewell’s herbalists are licensed, currently Massachusetts.
By purchasing the Signature Formula, you confirm your quiz answers are accurate and complete; the herbalist’s review depends on them, and inaccurate answers may make a formula unsuitable for you. By purchasing the Custom Formula, you agree to provide accurate and complete health information during intake and check-ins.
6. Subscriptions and billing
The Signature Formula is a monthly subscription at $59.99 per month. The Custom Formula is a monthly subscription at $129 per month, which includes your compounded Chinese Herbal Medicine formula, formula adjustments, and practitioner messaging as described at purchase.
Both subscriptions are billed in advance to your payment method through our payment processor, Stripe. Promotional pricing, including first-month discounts and founding member rates, applies only as described in the specific offer and reverts or continues per those offer terms. Prices may change with at least 30 days notice before the change affects your billing.
Your first charge occurs at checkout. A Signature Formula order ships after practitioner approval. A Custom Formula order is compounded after your intake consultation and your herbalist’s recommendation. Subsequent shipments follow your monthly billing cycle.
7. Pausing and cancelling
You may pause or cancel either subscription anytime from your account. Cancellation takes effect at the end of your current billing period; you will not be charged again, and any order already approved and shipped for the current period is not affected. Cancelling a Custom Formula subscription ends the associated practitioner care at the end of your billing period; your herbalist will advise you on concluding your formula. We do not provide refunds for partial months except as covered by the guarantee below.
8. Money-back guarantee (Signature Formula only)
Signature Formula first orders are covered by a 30-day money-back guarantee. If the Signature Formula is not right for you, contact us at aria@jadewell.me within 30 days of your first shipment’s delivery date and we will refund your first payment in full to your original payment method. The guarantee applies once per customer, to Signature Formula first orders only, and does not apply to the Custom Formula. We may ask what didn’t work, and your answer helps us but is not a condition of the refund.
9. Custom Formula preparation (Custom Formula)
Custom Formula granules are compounded specifically for you based on your herbalist’s recommendation and cannot be restocked or transferred. Once compounding has begun, orders cannot be cancelled for that billing period. Your herbalist may modify your formula between cycles based on your check-ins.
10. Shipping and risk of loss
We ship within the United States. Title and risk of loss pass to you on delivery to the carrier. Shipping timelines shown at checkout are estimates.
11. Your responsibilities
Use products only as directed, for the Signature Formula per the directions included with your shipment and for the Custom Formula per your herbalist’s instructions. Keep out of reach of children. Tell your physician and pharmacist about any supplement you take. Do not resell jadewell products. Do not use the site or quiz to provide information about another person without their consent, and do not misuse, scrape, reverse engineer, or interfere with the site or quiz.
12. Intellectual property
The site, the Pattern Quiz, pattern names and codes, formula matching logic, and all content are the property of jadewell, Inc. or its licensors. You may not copy, reproduce, or create derivative works from them without written permission.
13. Disclaimers and limitation of liability
The site and products are provided as is. To the maximum extent permitted by law, jadewell disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and our total liability to you for any claim arising from these terms or your use of the products or site will not exceed the amount you paid to jadewell in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law, and some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in this section limits your herbalist’s professional obligations to you under the Custom Formula.
14. Indemnification
You agree to indemnify and hold jadewell harmless from claims arising out of your violation of these terms or misuse of the products or site.
15. Dispute resolution
Any dispute arising from these terms will be resolved in the state or federal courts located in Delaware, and these terms are governed by the laws of the State of Delaware, without regard to conflict of law rules.
16. Changes
We may update these terms. Material changes will be posted with an updated date, and continued use after changes take effect constitutes acceptance. Changes to subscription pricing follow section 6.
